US Judge Mandates Release of Abrego Garcia from ICE Detention
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer alien smuggling allegations, he was held in immigration detention.
In her decision, the judge pointed out that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Context of the Case
The court proceedings center on conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in the state of Tennessee.

The judge, who was hearing his petition to deportation in a Maryland district court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This order shifts his monitoring to the Tennessee court.
